to Support Buy Clean Policies<\/strong><\/p><p>The final piece of President Biden\u2019s Inflation Reduction Act\u2019s (IRA) Federal Buy Clean initiative became clear when the Federal Highway Administration (FHWA) <a href=\"https:\/\/highways.dot.gov\/newsroom\/biden-harris-administration-opens-applications-1-billion-funding-decrease-air-pollution\">announced<\/a> on March 12, 2024 how its $2 billion program to accelerate the use of low-embodied carbon \u00a0(LEC) materials will be implemented.\u00a0 \u00a0The Environmental Protection Agency (EPA) and General Services Administration (GSA) have already issued policy documents, guidance, project, and grant announcements as part of the Federal Buy Clean rollout supported by the IRA legislation.\u00a0<\/p><p>Per the announcement, the <a href=\"https:\/\/www.fhwa.dot.gov\/lowcarbon\/?_gl=1*1e0b4pm*_ga*ODg2OTI5NTI5LjE2NjA1Njk2Njk.*_ga_VW1SFWJKBB*MTcxMDQyNzcxMy43LjEuMTcxMDQyODMzOC4wLjAuMA..\">Low Carbon Transportation Materials Grant Program<\/a> (LCTM) is now accepting <a href=\"https:\/\/www.fhwa.dot.gov\/lowcarbon\/rfa.pdf\">grant applications<\/a> from state transportation agencies to fund\u00a0 \u201cactivities\u201d and \u201cprojects\u201d that reduce emissions through the use of low-embodied carbon materials.\u00a0 According to the press release, FHWA is taking a hybrid approach to implement the program as follows:<\/p><ul><li>$1.2 billion is available to the states, DC, and Puerto Rico and can be applied for now under the \u201cRequest for Application (RFA) program announced by FHWA.<\/li><li>$800 million will be made available later this year for metropolitan planning organizations and local governments to participate in the program through a Notice of Funding Opportunity (NOFO).<br \/><br \/><\/li><\/ul><p><strong><u>Key Takeaways from Announcement<\/u><\/strong><\/p><ul><li>Each state is eligible for at least $22 million in grant funding.<\/li><li>LCTM applications due June 10, 2024.<\/li><li>Each state to submit only one application identifying projects to FHWA for consideration.<\/li><li>Only asphalt mix, concrete, steel, and glass eligible for funding<\/li><li>LCTM funds must be obligated by September 30, 2026<\/li><li>LCTM funds must be spent by September 30, 2031<\/li><li>Unused funds will be made available to other states<br \/><br \/><\/li><\/ul><p><strong><u>How Agencies Determine \u201cSubstantially Lower\u201d Embodied Carbon Thresholds<\/u><\/strong><\/p><p>Under the LCTM program, EPA determines what is an acceptable LEC material.\u00a0 Thus, the process an agency uses must be in alignment with <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2023-01\/2022.12.22%20Interim%20Determination%20on%20Low%20Carbon%20Materials%20under%20IRA%2060503%20and%2060506_508.pdf\">EPA\u2019s Interim Determination<\/a> (i.e., best performing 20 percent, 40 percent, and industry averages.)\u00a0 FHWA allows for one of two options that may be combined for agencies to consider:\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0<\/p><ul><li>Industry average information posted on FHWA\u2019s website (available in Spring 2024); or<\/li><li>Agency determines GWP thresholds utilizing accepted ISO standards.<br \/><br \/><\/li><\/ul><p><strong><u>Implementation Process Report (IPR)<\/u><\/strong><\/p><p>The first step each DOT will have to consider to access LCTM funds is to prepare an Implementation Process Report.\u00a0 This report documents how the state DOT plans to implement LCTM activities and increase use of LEC asphalt\/concrete.\u00a0 The IPR must be submitted and approved by FHWA before funding under the LCTM program is authorized.\u00a0<br \/><br \/><\/p><p><strong><u>What Asphalt Companies Should Be
