INTRODUCTION

SURFACE TECH (“ST”) respects your privacy and is committed to protecting it through its compliance with this policy.

This policy describes the types of information ST may collect from you or that you may provide when you visit the ST website surface-tech.com (the “ST Website”) and its practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information ST collects:

  • On the ST Website.
  • In email, text, and other electronic messages between you and the ST Website.

It does not apply to information collected by:

  • ST offline or through any other means, including on any other website operated by ST or any third party (including ST affiliates and subsidiaries); or
  • Any third party (including ST affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the ST Website.

Because ST primarily serves business customers (such as paving contractors, asphalt producers, agencies, and distributors), much of the information ST collects through the ST Website relates to individuals acting in a business capacity. Under applicable U.S. state privacy laws now in effect, business contact information is treated as personal information, and the rights described in this policy apply to it.

Please read this policy carefully to understand ST’s policies and practices regarding your information and how ST will treat it. If you do not agree with ST’s policies and practices, your choice is to refrain from using the ST Website. By accessing or using the ST Website, you agree to this privacy policy. This policy may change from time to time (see Changes to ST’s Privacy Policy). Your continued use of the ST Website after ST makes changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

CHILDREN UNDER THE AGE OF 16

The ST Website is not intended for children under 16 years of age. ST does not knowingly collect personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA), and does not knowingly sell or share the personal information of consumers under 16 as required by the California Consumer Privacy Act and other applicable state laws. If you are under 16, do not use or provide any information on the ST Website or through any of its features, or provide any information about yourself to ST, including your name, address, telephone number, email address, or any screen name or user name you may use. If ST learns it has collected or received personal information from a child under 13 without verification of parental consent, ST will delete that information. If you believe ST might have any information from or about a child under 16, please contact ST as described below under “Contact Information.”

INFORMATION ST COLLECTS ABOUT YOU AND HOW ST COLLECTS IT

ST collects several types of information from and about users of the ST Website, including:

  • Information by which you may be personally identified, such as name, postal address, email address, telephone number, or any other identifier by which you may be contacted online or offline (personal information);
  • Information that is about you but individually does not identify you; and/or
  • Information about your internet connection, the equipment you use to access the ST Website, and usage details.

ST collects this information:

  • Directly from you when you provide it to ST.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  • From third parties, for example ST’s business partners and analytics or advertising providers.

ST does not knowingly sell personal information for monetary consideration and does not knowingly collect personal information from minors for sale or sharing.

Sensitive Personal Information

ST does not knowingly collect sensitive personal information (such as government identifiers, precise geolocation, account credentials, racial or ethnic origin, religious beliefs, union membership, the contents of mail or messages, genetic data, biometric identifiers, health information, or information about sex life or sexual orientation) through the ST Website. If you voluntarily submit such information through a form or correspondence, ST will use it solely for the purpose for which it was provided.

De-Identified Information

Where ST maintains information in de-identified form, ST will: (i) take reasonable measures to ensure the information cannot be associated with an individual or household; (ii) publicly commit to maintain and use the information only in de-identified form and not to attempt to re-identify it, except that ST may attempt re-identification solely to determine whether its de-identification processes are effective; and (iii) contractually obligate any recipients of the de-identified information to comply with the same requirements.

Information You Provide to ST

The information ST collects on or through the ST Website may include:

  • Information that you provide by filling in forms on the ST Website, including information provided at the time you request further services or report a problem with the ST Website.
  • Records and copies of your correspondence (including email addresses) if you contact ST.
  • Your search queries on the ST Website.

Information ST Collects Through Automatic Data Collection Technologies

As you navigate through and interact with the ST Website, ST may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the ST Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the ST Website.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

This automatically collected information helps ST improve the ST Website and deliver a better, more personalized service, including by enabling ST to estimate audience size and usage patterns, store information about your preferences, speed up your searches, and recognize you when you return to the ST Website.

The technologies ST uses for automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. The ST Website uses the following categories of cookies: strictly necessary, functional, performance, analytics, and advertising. You may refuse to accept browser cookies by activating the appropriate setting on your browser, or you may manage your preferences at any time using the cookie settings link available on the ST Website. If you disable or refuse cookies, some parts of the site may be inaccessible or may not function properly.
  • Web Beacons. Pages of the ST Website and ST emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit ST, for example, to count users who have visited those pages or opened an email and for other related website statistics.

THIRD-PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES

Some content or applications on the ST Website are served by third parties, including analytics providers and advertising networks. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use the ST Website. The information they collect may be associated with your personal information, or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

ST does not control these third parties’ tracking technologies or how they may be used. HOW ST USES YOUR INFORMATION

ST uses information that it collects about you or that you provide to ST, including any personal information:

  • To present the ST Website and its contents to you.
  • To provide you with information, products, or services that you request from ST.
  • To fulfill any other purpose for which you provide it.
  • To carry out ST’s obligations and enforce ST’s rights arising from any contracts entered into between you and ST, including for billing and collection.
  • To notify you about changes to the ST Website or any products or services ST offers or provides through it.
  • In any other way ST may describe when you provide the information.
  • For any other purpose with your consent.

ST may also use your information to contact you about ST goods and services that may be of interest to you. If you do not want ST to use your information in this way, please “unsubscribe” as directed in the email contact you receive. Data Retention

ST retains personal information only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, contractual, or reporting requirements. When personal information is no longer needed, ST will securely delete or anonymize it.

Automated Decision-Making

ST does not use your personal information collected through the ST Website to make solely automated decisions that produce legal or similarly significant effects concerning you.

Financial Incentives

ST does not offer financial incentives (such as payments, discounts, or other rewards) in exchange for the collection, sale, sharing, or retention of personal information.

DISCLOSURE OF YOUR INFORMATION

ST may disclose aggregated information about ST users, and information that does not identify any individual, without restriction.

ST may disclose personal information that it collects, or that you provide as described in this privacy policy:

  • To ST subsidiaries and affiliates.
  • To contractors, service providers, and other third parties ST uses to support its business (each of which is contractually obligated to keep personal information confidential and use it only for the purposes for which it is disclosed).
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of ST’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by ST about ST Website users is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by ST when you provide the information.
  • With your consent.

ST may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply ST’s terms of use, terms of sale, and other agreements, including for billing and collection purposes.
  • If ST believes disclosure is necessary or appropriate to protect the rights, property, or safety of ST, ST customers, or others, including for the purposes of fraud protection and credit risk reduction.

ST does not sell personal information for monetary consideration. To the extent any of ST’s data sharing with advertising or analytics partners is considered a “sale” or “share” for cross-context behavioral advertising under applicable state law, you may exercise your right to opt out as described below.

CHOICES ABOUT HOW ST USES AND DISCLOSES YOUR INFORMATION

ST strives to provide you with choices regarding the personal information you provide to ST. ST has created the following mechanisms to provide you with control over your information:

  • Cookie Preferences. You can manage your cookie preferences at any time using the cookie settings link available on the ST Website, or by setting your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Global Privacy Control (GPC). ST honors opt-out preference signals, including the Global Privacy Control, sent by browsers or browser extensions for users in jurisdictions that recognize such signals. When ST receives a GPC signal, ST will treat it as a request to opt out of the sale or sharing of personal information for that browser and, where feasible, for the associated user.
  • “Do Not Track” Signals. Because no consistent industry or legal standard for recognizing or honoring “Do Not Track” (DNT) signals has been adopted, the ST Website does not currently respond to browser-based DNT signals. ST does, however, honor the Global Privacy Control as described above.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want ST to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt out by sending ST an email with your request to info@surface-tech.com.
  • Promotional Offers from ST. If you do not wish to have your email address or contact information used by ST to promote ST or third parties’ products or services, you can opt out by unsubscribing when you receive such promotion or at any other time by sending ST an email stating your request to info@surface-tech.com. This opt-out does not apply to information provided to ST as a result of a product purchase, warranty registration, product service experience, or other transaction.

ST does not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website, and from members of the Digital Advertising Alliance (“DAA”) on the DAA’s website.

ACCESSING AND CORRECTING YOUR INFORMATION

You may submit a request to access, correct, or delete personal information that you have provided to ST by either of the following methods: (i) email info@surface-tech.com; or (ii) postal mail to Surface Tech LLC, Attn: Privacy, 888 Prospect Street, Suite 200, La Jolla, CA 92037. ST may not accommodate a request to change information if ST believes the change would violate any law or legal requirement or cause the information to be incorrect.

Residents of certain U.S. states and Canadian provinces may have additional rights and choices. Please see Your Privacy Rights below for more information.

YOUR PRIVACY RIGHTS

U.S. State Residents

Depending on your state of residence, you may have some or all of the following rights regarding your personal information:

  • Right to Know / Access. The right to confirm whether ST is processing your personal information and to request a copy of the personal information ST has collected about you, including (for California residents) information collected in the prior twelve (12) months.
  • Right to Delete. The right to request deletion of personal information ST has collected from you, subject to certain exceptions.
  • Right to Correct. The right to request correction of inaccurate personal information.
  • Right to Data Portability. The right to obtain a copy of your personal information in a portable, readily usable format.
  • Right to Opt Out of Sale or Sharing. The right to opt out of the sale of personal information and of sharing personal information for purposes of cross-context behavioral advertising.
  • Right to Opt Out of Targeted Advertising and Profiling. The right to opt out of processing of personal information for purposes of targeted advertising or profiling that produces legal or similarly significant effects.
  • Right to Limit Use of Sensitive Personal Information. Where applicable, the right to limit ST’s use and disclosure of sensitive personal information.
  • Right to Non-Discrimination. The right not to receive discriminatory treatment for exercising any of these rights.
  • Right to Appeal. In certain states, the right to appeal ST’s decision regarding a privacy rights request.

These rights may be available to residents of states including, without limitation, California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, subject to the specific provisions and exceptions of each state’s privacy law. How ST Verifies and Responds to Privacy Requests

To protect your information, ST will take reasonable steps to verify your identity before responding to a privacy rights request. Depending on the nature and sensitivity of the request, ST may ask you to confirm information ST already has about you (such as your name, email address, and the nature of your prior interactions with ST), and ST may ask you to provide additional information sufficient to match you to the personal information in ST’s records. ST will not use information collected for verification for any other purpose.

ST will generally respond to verifiable privacy rights requests within forty-five (45) days of receipt. If ST requires more time (up to an additional 45 days), ST will inform you of the reason and the extension period in writing. If ST cannot fulfill your request, ST will explain why.

You may designate an authorized agent to make a request on your behalf. To do so, your authorized agent must provide ST with: (i) signed, written permission from you authorizing the agent to act on your behalf; (ii) proof of the agent’s identity; and (iii) verification of your own identity directly with ST. ST may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf.

California “Shine the Light”

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents to request information regarding ST’s disclosure of personal information to third parties for those third parties’ direct marketing purposes. Canadian Residents

If you are a resident of Canada, you have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, including Quebec’s Act respecting the protection of personal information in the private sector (Law 25). These rights generally include the right to access, correct, and obtain a copy of your personal information; the right to withdraw consent to its processing; and, in Quebec, the right to data portability and to be informed about automated decision-making. ST’s commercial electronic messages also comply with Canada’s Anti-Spam Legislation (CASL): each commercial email identifies the sender, provides ST’s contact information, and includes a working unsubscribe mechanism. Other Jurisdictions

If you are accessing the ST Website from outside the United States and Canada, please be aware that information ST collects will be transferred to, stored, and processed in the United States. By using the ST Website, you consent to the transfer of your information to the United States and its processing in accordance with this policy.

DATA SECURITY

ST has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to ST is stored on ST’s secure servers behind firewalls.

Unfortunately, the transmission of information via the internet is not completely secure. Although ST does its best to protect your personal information, ST cannot guarantee the security of your personal information transmitted to the ST Website. Any transmission of personal information is at your own risk. ST is not responsible for circumvention of any privacy settings or security measures contained on the ST Website.

In the event of a data breach affecting your personal information, ST will notify affected individuals and applicable regulatory authorities as required by law.

CHANGES TO ST’S PRIVACY POLICY

It is ST’s policy to post any changes it makes to this privacy policy on this page with a notice that the privacy policy has been updated on the ST Website home page. If ST makes material changes to how it treats users’ personal information, ST will notify you through a notice on the ST Website home page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for periodically visiting the ST Website and this privacy policy to check for any changes.

As a leader with both creative and analytical skills, Jason oversees the planning, development, and execution of Surface Tech’s marketing and advertising strategies. He has been responsible of late for clarifying the company’s value proposition through a series of new branding executions resulting in a revamped website and other improvements in the company’s strategic marketing initiatives.

Jason brings more than 25 years of industrial design, branding, and manufacturing experience to his new role as CMO. His work has appeared in leading design publications, and he has received numerous international design awards. His portfolio includes more than 40 design and utility patents in the fields of consumer electronics, software, packaging, medical devices, and software. Speed to market, with a critical eye for detail and simplicity, is the driving force behind his multidisciplinary design process.

Jason holds a BS in Industrial Design from The Ohio State University. His previous work experience includes Nike, Proctor & Gamble, Skylab Architecture, and founder of New Studio. 

Stacie Steel

U.S. Northwest

Stacie Steel, PE, offers a depth of experience in asphalt and concrete pavements. She has provided infrastructure-related civil engineering and project management consulting services to both public and private sector clients for the past 20 years.

Stacie’s technical expertise centers around all things pavements: structural design, materials design and specifications, sustainability, life-cycle cost analyses, pavement management, preservation and rehabilitation, QA/QC, materials testing, and forensic evaluations.

Throughout her career, she has worked on paving projects for many national commercial retailers, municipalities, and airports. Stacie has proven leadership and organizational capabilities, as evidenced by earning the President’s Choice Award from the WTS Colorado Chapter early in her career. She currently serves on the WTS Puget Sound Chapter’s TransportationYOU Committee, and is dedicated to ensuring access to local outdoor recreation opportunities serving on the Board of Directors for the Lonesome Lake Preservation Group.
